These terms apply to the use of this website and to photography services provided by Lumens & Grace Photography (“we”, “us”, “our”). By using this website or booking a session with us, you agree to these terms. Please read them carefully.
Part A — Booking Terms
These booking terms summarise the key terms on which we provide photography services. They are given to you before you book, as required by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Full terms are set out in the contract you sign before your session or wedding, and that contract takes precedence if there is any difference between it and this summary.
1. Who we are
Lumens & Grace Photography is a photography business owned and run by Adrian Chiu, a sole trader based in West Lothian, Scotland, serving Edinburgh, the Lothians and central Scotland. You can contact us at adrian.chiu@lumensandgracephotography.co.uk and we will respond within two working days.
2. Prices and what's included
Current prices, session lengths and deliverables are shown on our Packages page. Prices are in pounds sterling and include VAT where applicable. We are not currently VAT registered, so no VAT is added to our fees.
Prices shown on this website are indicative and may change. The price for your booking is the one confirmed in writing in your quote and contract, and that price is held once your contract is signed and your retainer is paid.
3. Holding your date
Dates are not held on enquiry. Your date is confirmed only once we have received both your signed contract and your retainer. Until then we may accept another booking for the same date.
4. Payment
For weddings, payment is made in stages: a 25% non-refundable retainer on signing, a further 25% six months before the wedding date, and the remaining 50% no later than 28 days before the wedding date. Where a wedding is booked less than six months ahead, the retainer is followed by the remaining 75% no later than 28 days before the date.
For portrait, proposal and event sessions, a retainer is payable on booking with the balance due before the session, as set out in your contract.
The retainer is non-refundable. It reserves your date, and once it is accepted we turn away other enquiries for that date.
5. Travel
Travel is included at no additional charge where your venue and all shoot locations are within an EH postcode. Outside an EH postcode, travel is charged at 45p per mile round trip from our base in the EH52 postcode area, plus any parking, tolls or ferry charges. Overnight accommodation may be charged where the day starts before 8:00am or the venue is more than 90 minutes away. We may waive or reduce these charges at our discretion, and any charges are agreed with you in writing before your date.
6. Cancellation by you
If you cancel, the retainer is not refunded, and the following charges apply as a percentage of the total fee, based on the date we receive your written notice:
More than 6 months before the date: the retainer only (25%)
Between 3 and 6 months before: 50%
Between 28 days and 3 months before: 75%
Less than 28 days before: 100%
These charges reflect the fact that your date is reserved exclusively for you and other enquiries are declined.
7. Postponement
You may postpone your date once to an alternative date within twelve months, subject to our availability, by giving at least 90 days' written notice. Sums already paid transfer to the new date. Where we are not available, where you give shorter notice, or where you ask to postpone a second time, this is treated as a cancellation under section 6.
8. Your right to cancel under the Consumer Contracts Regulations 2013
Where a contract is agreed at a distance — by email, telephone or online — consumers usually have 14 days in which to cancel and receive a refund.
That right does not apply to contracts for services related to leisure activities where the contract provides for a specific date or period of performance (regulation 28(1)(h) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013). Weddings, portrait sessions, proposals and events booked with us are for a specific date, and so the 14-day cancellation right does not apply to them. The cancellation terms in section 6 apply instead, and these are made clear to you before you book.
Where we agree a booking that is not for a specific date — for example a gift voucher, or a session where no date has been fixed — you do have 14 days from the day after the contract is made in which to cancel for a full refund. If you ask us to begin work within that period, and we do, we may charge you a proportionate amount for the work carried out before you cancelled. 9. If we cannot attend
If we are unable to attend because of illness, injury, accident, bereavement or another emergency, we will use all reasonable efforts to arrange a replacement photographer of comparable style and experience, subject to your agreement, and we will still edit and deliver your images where we are able to. If no replacement can be agreed, we will refund all sums paid, including the retainer, and our liability ends there.
10. Delivery
For weddings, we deliver a preview selection of around 10 to 15 edited images within 7 days, and your full edited gallery within 8 weeks. Timescales for other sessions are set out in your contract. Galleries are hosted on Pixieset and remain available for at least 12 months from delivery. Please download and back up your images within that period.
We deliver the images we consider, in our professional judgement, to be of deliverable quality. We do not supply unedited or RAW files.
11. Your images and our use of them
We own the copyright in all photographs we take. You receive a licence to use your images for personal purposes, as set out in your contract. Where you are booking on behalf of a business, charity, school or other organisation, a separate commercial licence applies.
We may use selected images from your session in our portfolio, on this website, on social media and in advertising. You can ask us not to use particular images for promotional purposes at any time and we will comply as soon as we reasonably can, although we cannot recall images already printed or published.
12. Reviews and testimonials
Where you leave us a review or send us feedback, we may quote it, along with your first name and the type of session, on our website, on social media and in marketing. Tell us if you would prefer we did not.
13. Complaints
We want you to be happy with your experience. If something has gone wrong, please email adrian.chiu@lumensandgracephotography.co.uk with the details and we will acknowledge your complaint within three working days and aim to resolve it within 14 days. Nothing in these terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.
Part B — Website Terms
14. Intellectual property
All content on this website, including photographs, text and layout, is the property of Adrian Chiu, Lumens & Grace Photography, unless otherwise noted. You may not reproduce, use or distribute any of it without our prior written permission.
15. Image usage
Photographs on this site are for display purposes only. You may not download, copy, screenshot, reuse, republish or redistribute them without our express written consent.
You may not use automated systems to scrape, harvest or copy the contents of this website, and you may not use any content from this website to train, fine-tune or develop artificial intelligence or machine learning systems. This is an express reservation of rights for the purposes of any text and data mining exception.
16. Licensing and permissions
Some images may be available for licensing. Usage rights, fees and permissions are discussed case by case. Please contact us.
17. External links
This website may link to third-party sites. We do not control or endorse their content and we are not responsible for their privacy or business practices.
18. Privacy and cookies
Your use of this site is also governed by our Privacy Policy, which explains how we collect, use and protect your data under the UK GDPR. This site uses cookies for analytics and user experience; you can manage your preferences through our cookie banner or your browser settings.
19. Accuracy of the website
We work to keep this website accurate and up to date, but we do not guarantee that it is error-free or always available, and we are not liable for losses arising from reliance on out-of-date content on the site. Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited or excluded.
Part C — General
20. Governing law
These terms, and any contract for photography services, are governed by the law of Scotland, and any dispute will be subject to the exclusive jurisdiction of the Scottish courts.
21. Changes to these terms
We may revise these terms from time to time. The version in force when you book is the version that applies to your booking. Continued use of this website means you accept the current website terms.
